New Delhi/Jammu/Srinagar, June 22, 2019: This is most unfortunate that the J&K press/media is being misled by certain media agencies/state on the actual/constitutional state of affairs being faced by the population of the state. The three regions namely, Ladakh, Kashmir Valley and Jammu province as the present constitutional constituents of the state have different language, different climate and distinct population. Nearly one-third of the state stands illegally occupied by Pakistan which include Gilgit-Baltistan region and western areas of Jammu province since 1947/48. The territory was invaded by the raiders in 1947 with the arms support of newly created Pakistan. They occupied nearly 5000 acres of J&K territory of Jammu province. This small territory occupied by Pakistan since October 1947 was named by Pakistan as so-called ‘Azad Jammu and Kashmir’ just to mislead the world and hide its illegal occupied of a portion of the territory of J&K. Later Pakistan used its military and Pakistan Army attacked Gilgit & Baltistan in 1948 when it fell under territorial jurisdiction of the State of J&K under the rule of Maharaja Hari Singh. It was in November 1948 when Pakistani Army invaded Gilgit-Baltistan, arrested the then Governor of Gilgit-Baltistan, Brig. Ghansara Singh and lodged him prison. The United Nations failed to discharge its duty according to the International Laws. Brig. Ghansara Singh was released after Govt. of India agreed to return some of the J&K leaders from J&K who intended to leave J&K and go to Pakistan. This was the reason that Pakistan remained illegal occupant of nearly one-third of territory of J&K. The territory Pakistan occupied by invading Poonch-Muzaffrabad sector Pakistan described it as ‘Azad Kashmir’ (Independent) and other areas of Gilgit-Baltistan where Pakistan remained as illegal occupant has been annexed by Pakistan firstly to illegal occupation and secondly by forcing that territory to be annexed as one of Pakistan districts, Gilgit-Baltistan, a territory comprising nearly 32,000 sq. miles (not kms.). Pakistan played another fraud by ceiling about 4500 sq. miles of Gilgit region to China in 1963 in a Treaty signed by Zulfiqar Ali Bhutto, Foreign Minister of Pakistan and Chou-en-Lai, Foreign Minister of China. This territory China has built up as a war region plank building over 60 war helipads and connected Beijing (China) with Peshawar by road for the first time in the history of China. This was China first chance when it carved out a connection from Beijing to Asia (Peshawar). This treaty signed by China with Pakistan in 1963 was totally illegal, unconstitutional and violative of international law and obligations. After Mr. Krishna Menon no Indian representative could dare/care check United Nations flaws vis-à-vis J&K which has remained Pakistan’s continuous aggression.
The stories floated through a sponsored agency, IANS from Srinagar that ‘decision to call for delimitation files from J&K Law Department has fuelled speculation on the future of State Assembly elections’ is sponsored story with an ugly intrigue to ensure that J&K does not go for delimitation on any pretext. This sponsored story has also given the wrong impression about the distribution of Assembly seats among three regions of the state. The fact is that the Assembly seats are distributed according to the population, area as well as terrain. There are total 87 seats at present in J&K. Four Assembly seats all in Ladakh which has population of 274289 according to the 2011 census. Interestingly, the census in 2011 shows population of Kashmir Region as 6888475. The population of Jammu Province is shown as 5378538. This is very interesting to mark that census 2001 had recorded the population of Kashmir Region as 5514092 and Jammu Province as 4430191. This difference shown in official record of two census is very important to note by all political leaders as well as intellectuals and opinion mongers. It shows that population of Jammu province rose from 4430191 to 5378538. Population of Kashmir Valley rose from 5514092 to 6888475. This means the population of Kashmir Valley rose by 10 years i.e. 2001 to 2011 by 1374383. This is on record and I want to point out for all politicians, parliamentarians, intellectuals, journalists and press barons, kindly go through the subject matter and answer this question to ourselves what is this intrigue. Nearly 5 lacs. Kashmiri Pundits (all Kashmir residents) migrated from Kashmir Valley in 1990-91. Besides several non-Pundits, both Hindus and Muslims mostly from Jammu province also migrated from the Valley because of the terror that ruled the state during nineties. The entire world knows that hundreds of Kashmiri Muslim brethren also left the Valley and migrated to the rest of the country. This has been immensely projected that nearly 10 Lacs of local residents of Kashmir Valley had migrated from Kashmir Valley. Lacs have settled in Jammu province itself. This fact none can denied on earth that population of Kashmir Valley was reduced and it should have been recorded in the census 2011. Shocking that Govt. of J&K has played a big mischief/crookery rather a fraud with the rule of law and got census framed according to its own choice with ulterior motives. Census of 2011 was a big fraud and the government at that time does not deserve any forgiveness. Besides, the census framed under the Govt. of J&K at that time which used/utilized the administration to forge the fraudulent records. This was the reason that population was shown to have reason by over 13 lacs. Also several thousands of youth had illegally migrated from Kashmir to Pakistan which is on record and could not have been hidden. This is the reason that some ex-rulers of Kashmir managed the national leadership and forged a fraudulent alliance with BJP thus meaning fraudulently all the three seats to the Lok Sabha from Kashmir Valley leaving three other seats, two from Jammu province and one from Ladakh for ruling BJP. This is a conspiracy which should have been detected in the national interest. The party I founded in 1982 known as Panthers Party believes in nationalism and not in bargains or political interest at the cost of the nation. The stories floated by an agency (IANS) on June 21, 2019 from Srinagar deserve a compassionate and serious intention of all nationalists who sitting in judgment from Delhi. This story from Srinagar is misleading, concocted and forcibly pushed to net cannot be believed and should be registered by all those who have a nationalist feelings for Jammu and Kashmir. What needs to be done vis-à-vis J&K for its total integration with the rest of the country should be questioned before us all from a parliamentarian to a press reporter and political worker.
This should not be forgotten by all those who believe in Indian nationalism, rule of law and secular democracy that J&K deserves to be treated at par with all the provinces of the country. There is an urgent need for delimitation which has not been conducted since 1995. 25 years have gone and there is no reason to hang on for another 10 years or so. There is an urgent need for National Integration and application of all universal laws and rules vis-à-vis Jammu and Kashmir which are applicable to all the states in the country. Fundamental rights applicable to all the states deserve to be applied to all the Indian citizens residing in J&K. That’s why one Constitution and one Flag with all Fundamental Rights to every citizen of India in J&K is the urgent need of the hour.
